The ICF is an entity with its own legal personality whose operations are regulated by the Institut Català de Finances Act, the Catalan government-owned enterprise charter and the rest of the legal system. It also complies with the rules of private law applicable to it, specifically with the regulations governing credit institutions.
Likewise, the ICF has its own assets and cash and in the performance of its role operates autonomously in terms of its organisation, finance, assets, functions and management with full independence from public administrations.
The ICF is mainly financed by borrowing from Spanish and European public and private financial institutions and entities.
The ICF is not funded by the Catalan Government’s budget. It is classified by the Bank of Spain as a non-monetary financial institution and ratified by Eurostat as a financial institution outside the perimeter of public administration (ESA).
For these reasons, the bulk of the ICF’s operations do not add any deficit or debt to the Government of Catalonia.
The ICF Group undertakes its activity within the regulatory framework of private law, with the exception of its public procurement activity which is governed by the Public Sector Contracts Act. It thus does not have any kind of service charter or procedures catalogue.
The ICF Group does not implement public policies on territory, urban planning, environment, mobility or territorial facilities as part of its activity. There are no sector territorial plans or any territorial planning approved by any ICF Group companies.
The ICF Group does not operate under the approach of general or sector plans and so there is no documentation that needs to be included in this section as the subject-matter of active advertising. By contrast, the general strands set by the Ministry of Economy and Finance, through which the ICF interacts with the Government of Catalonia, are applicable as general action guidelines.
No entity of the ICF Group has any autonomy to issue any kind of general regulation, directive, instruction or circular. In order to undertake any legislative initiative, it would need the support and processing of the Ministry of Economy and Finance through which it interacts with the Government of Catalonia. In this respect, you can see the Act that set up the ICF.
The ICF Group also has no power over the administrative intervention regime and the review of administrative acts.
